Notes study Rutgers, New Jersey Auto Insurance laws fundamentally flawed
A study by John D. Worrall, professor and chair of economics at Rutgers University - Camden, concludes that “New Jersey’s auto insurance laws are fundamentally flawed, ineffective and ensure a volatile market, is not the state, or different because motorists insurer. ”
Worrall findings seem to support the complaint by New Jersey’s auto insurer, many of whom are no longer in search of activity in the state. His study “, a roadmap for market stability for the New Jersey movement of persons deprived of automobile insurance”, published by the American Insurance Association, notes that “the violation of implicit contracts and laws to deny that flexibility because of changing conditions led to a loss of the insurer - more than twenty in the last twelve years - while discouraging the entry of new companies. ”
“While we fought for almost 30 years with a” fix “after another, our system is still ineffective,” said Dr. Worrall. “Too much regulation stifles competition and freedom of choice of consumers.” he believes that the rules effectively to the end consumer.
The study finds that the emergency measures put in place over the years, have never been implemented effectively, so that instead of harmful practices, and not for the implementation of necessary reforms. The contrasts with the approach adopted in other countries, including South Carolina, Illinois and the District of Columbia, “the gradual disappearance of anti-competitive practices, the restoration of freedom of choice for consumers, enlargement market and doubling the number of firms, insurance, to sell. ”
Worrall’s recommendations following: “directly previously adopted modalities for the implementation of reforms, the abolition of ‘Take-All-youth” and non-abolition of rules and the elimination of 6 percent-Cap-Auto insurer on profits . ”
“It was very clear for a long period, that the state regulation of auto insurance does not allow the progress of drivers and not the insurance industry,” said Dr. Worrall. “New Jersey must instill more competition among insurers and pilots a wider choice. Legislator, just read South Carolina, Washington, DC and Illinois to see that genuine reform, which benefits all can be achieved.
